E39 540i stays in 2nd gear when stopped?

Not sure if this is a normal thing to do but from time to time when I come to a stop the car decides to stay in 2nd rather than down into 1st. Obviously this can be a bit annoying if I want to do a quick take off after stopping.. just curious if this is normal? It doesn't have any problems starting in 2nd with the torque but it isn't quick off the line!

If you switch to sport mode it goes into first? Correct me if i'm wrong

pretty sure its normal, just put it into kickdown and it should take off in first

Normal... in sports mode it will select 1st and won't lockup in 5th.. you will also get engine braking in sports.

It will select 1st under load though, either full throttle or towing
