Proposed Land Transport (Road User) Amendment Rule [2011]

This is to advise that the public consultation (yellow) draft of the Land Transport (Road User) Amendment Rule [2011] (Rule 61001/6) has been released for comment. This proposed amendment Rule will amend Land Transport (Road User) Rule 2004 (the Rule), which sets out the rules under which traffic operates on New Zealand’s roads. It applies to all road users, whether they are drivers, riders, passengers, pedestrians, or persons leading or droving animals.

The amendment Rule proposes to change the give-way rules and to make other more minor changes that will affect road users. Changing the current give-way rules is a road safety priority in the Government’s road safety strategy, Safer Journeys – New Zealand’s Road Safety Strategy 2010-2020. Other proposals in the amendment Rule are intended to improve school bus safety and to strengthen or clarify other existing requirements, and to remove requirements that are no longer needed. Changes are also required to ensure the Rule is consistent with Land Transport Rule: Traffic Control Devices 2004.

Easiest to understand would be the overview, but definately looking forward to NZ bringing in the same giveway rules that have been used overseas by the majority of countries.

And I am pretty sure that most drivers I have come across believed this was already the rule

Proposal 2. It is proposed to amend the Rule to require all traffic

from a terminating road at an uncontrolled intersection to give way

to all traffic travelling on a continuing road.

This, is what most people believe was the case now:

Driveways. Currently, if a driveway is a public entrance or exit, for

example, at a supermarket, hospital or airport, it must be treated as an

uncontrolled intersection. Given the differing designs and locations of

driveways, the NZTA believes it would unnecessarily complicate the

proposed changes to the give-way rules if driveways were to be

included within the definition of an intersection. Instead, it is

proposed to add a new requirement in clause 4.4 of the Rule to require

that a vehicle exiting a driveway give way to vehicles on the road.

As above, the proposed changes make sense and are more logical, but, about 50% of the drivers on the road don't know the current rules - chances of them knowing the new ones? Will take a while but eventually they should all get it.

I won't hold my breath for people to get to know the new one. Whatever the rule might be, people on the road just do what they THINK the rules are without regards. Rule change will bring less confusions for the tourists but not so much for NZ public especially the oldies that are used to our current rules.
