Im sure insurance assessors have seen 'swapped' wheels etc a million times when assessing a car and it could be detrimental to any claim if Ian is seen to be trying to put one over on them. You can buy the car back for dirt cheap (I bought my last heavily rear-ended, $3500 paid-out, E30 back off State for 250dollars) Win super win. Apart from the hassle and losing a nice as car.. You should not need to buy it back.. unless they are going to pay for all the modifactions/upgrades to be done to the replacement vehicle.. They will only pay market value for the car which will not take into consideration the wheels/suspension anything else he has done to it. As was the case with my brother he had quite a heavily modified engine with brakes and suspension to suit. The insurance company would only consider paying market value for his car and would not take into account any modifications.. put forward to the insurance company a sensible amount to buy a car in the same condition plus his car back so he could transfer all of his blood sweat and tears into the replacement.. or see you in court basically.. Eventually it was sorted with the asking amount plus the return of his car. It will pay to have someone who is able to construct some very well written letters handy. Tomorrow I should hear back from the repairer who I have elected to proceed with repairs if it is 'worth it' what their quote is and if it's a write off or not. If It help my mum’s BMW was reversed into and she elected Evan’s European as the repairer and the insurance company covered it, she didn’t muck around with multiple quotes or seeing their recommended repairers she just went straight to the best and sent the insurance company the quote/bill.. BM WORLD 1283 Report post Posted November 18, 2009 (edited) you have the right to take the other guy to court and his insurance company will pretty much have to come to the party . i had a guy do a U turn in front of me a few years back , i claimed against his insurnace company ,as i h=only had third party . they where going to write off the car and pay out about $1000 , i told them it was worth alot more than that to me because i had done this and that etc . so they ended up paying out enough to cover the repair and i sent them a bill for a rental car for about 4 weeks too (company van from where i worked) they paid that as well Edited November 18, 2009 by Brent HARTGE535i Quote Share this post Link to post Share on other sites
Wom 0 Report post Posted November 18, 2009 The key to dealing with insurance company's is to stick up for yourself and if you don't like their decision, then challenge it. If they don't change their stance after the 1st challenge, then challenge them again and involve managers. If you're still not happy, then threaten to take them to the insurance ombudsman and Fair Go and that should help change their mind.
