Driftit 2080 Report post Posted December 17, 2009 (edited) I will start off saying that I have been a bit of a muppet and have left two unpaid fines with the courts. One for $200 and one for $100. 114kph passing a truck and doing 61 in a 50. Bad luck boo hoo. Being a student (now jobless) with no income I called the courts at the end of last year to organise a payment scheme of about $10 a week. They declined and wanted me to prove I earned no money. They wanted $50 per week. Since then I forgot about it all. And had no further letters or contact from them. Today some huge lady turns up stating she is here to collect my 318ti. As you can imagine I was thinking WTF I own a 540 not 318. She points out my sisters car. Then shows me my name registered to it. I then realise that once again the awesomeness of the LTSA has screwed me. All our cars should be registered under the family trust. Somehow this one has been left out. And because I was the one who registered it last time for my sister they think it is mine and want to take it. Once again I don't have any money. So she tells me that she will clamp the car until the fine is paid. I agree to this as I know it is just a mistake and we have proof of this mistake stating the car should be under the family trust. But once I tell her it is a mistake and that I can sort it out today and that the clamping suites, she changes her tactics. I then quickly realise that she gets commission for these jobs. After quite an obvious fake phone call to her boss. She states that they have to seize the car. Straight away I call her bullshit and she gets quite defensive. I then get angry because she is not going to clamp the car or give me any time to sort out this easy and obvious mistake. She knows that if I can fix the blatant mistake and that I will no be paying until I get an income. Thus meaning she doesn't get her commission for retrieving the funds. So I was forced to use my fathers credit card details to pay her. Or pay the ridiculous extra towing and storage fees until I sort it out. (Around $200). I then look up the registration details and find that just because a car is registered to you does not legally make you the owner of the car. It just makes you responsible for that car. The lady had lied to me stating that the law states if the car is registered to me it is legally mine. I had every intention to pay my fines once I had employment. But due to the lies and filthy tactics this lady used I was forced to borrow money from my father. Thank god I was able to do so. If not my sister would loose her car. Now I bet I won't be getting any family xmas presents this year. And I don't have a $ to my name anymore. Moral of the story Don't get fines. If you do get fines, rob a dairy to pay them off if you are not employed. Or sell a kidney. Would be less hassle. Don't trust court employees, just because they are sworn in, does not mean they won't BS you to get their commission. Double check any info the LTSA has on your cars. They missed three words on my sheet. (The *** Trust). I am however making a formal complaint against the officer. As even the lady I called at the courts agreed that it was unfair. Not expecting anything from them though. They have their money now. They could not care less who is being harmed in he process. Mark 178 Report post Posted December 17, 2009 You screwed up, you admitted it and yeah... /thread. Having said that... do you purposely put your cars in the family trust so that they can't be taken away when you "forget" to pay your fines or other debts? You're not the head honcho of Hanover Finance are you?
Driftit 2080 Report post Posted December 17, 2009 (edited) I am only a victim of dirty tactics and lies. Not of anything else. Nor did I state I was. Our cars are owned by the trust. And were paid for by the trust. I don't actually own a car myself at the moment. Just don't expect any leniency from the courts like I did. Especially if there is commission involved. This is the first time I have experienced it. And did not expect a sh*t storm of lies from a sworn in court officer. Heads up for anyone else that has not dealt with them. Apex 693 Report post Posted December 17, 2009 You had unpaid fines and you are clearly in a capacity to cover them but still you didn’t, you deserve what you get. Had you paid your fines it would have saved the Justice system a lot of time and the tax payers a lot of money.
