Dingo 1 Report post Posted October 10, 2013 HI all I have a couple of E30's at the moment and I'm about 3/4 through swapping the engines between the two. I have a 320I with body in pretty good nick that I'm putting a M20 2.8 stroker in. So i have pulled the engine out of this car and have the reg on hold and the wof has since lapsed. I pushed the car on to the street outside my house while I have been working on the donor car in the garage. Since the car is on the street with no reg or wof the council (chch) have stung me with a $400 fine. Am I completely in the wrong here or can I do something about this. I will write a letter and explain the situation since I think this is pretty rough considering I have paid up reg and wof on the donor car and my daily. its not like I'm driving around with no reg or wof. I'd like to hear your thoughts if anyone has been through similar situation before. I'm hoping they will be reasonable if they consider the situation. lord_jagganath 421 Report post Posted October 10, 2013 (edited) Got stung in Chch. Send them a letter explaining your circumstances. (and make sure you put a time period of when you had the car out on the street) and yes, it is illegal to park outside without a wof and reg on the street. bty .. was this east side? Phil-540i 166 Report post Posted October 10, 2013 Yes, hate to break it to you but it is illegal, & they are hard on it in Chch, bigtime. Nice money-making scheme really in circumstances like yours. Comes back to 'legal definition of a road' & various bits in the Land Transport Act. If they're being really queer, they can ticket it on the grass verge outside your place too.......stupid bit is the fine in your situation, is twice what it is for a 'moving vehicle' violation (Eg, if you'd been driving it with no wof........) Letter, & 'expecting them to be reasonable' while they are finding an excuse to extract money from you?? Hmm - you want the Tui ad guys to ring you on landline or mobile........ Phil-540i 166 Report post Posted October 10, 2013 Buy a car cover from supercheap and cover the car. You neighbours will love you too. I like the idea lots, but then they'll just lift one end of the cover, run the plate, & issue the ticket anyway. Plus if its on a road, you'd maybe then run the risk of being done for 'no rear red reflector' when its parked out there at night - the council guys are seriously picky down in Chch ae...... The car is on the road so therefore should have all the bits and pieces to say it is allowed on there. Pics of project?? westy 614 Report post Posted October 10, 2013 Doesn't even need to be on the road to be illegal. Cuncils should never have been allowed to issue anything but parking tickets.

Palazzo 477 Report post Posted October 10, 2013 As the reg is on hold, I'd argue that, it counts as a continuous licence, so can't see why if LTSA recognises it, council doesn't. The wof on the other hand, try a letter, but I don't like your chances. Are you sure a neighbour didn't complain?

Phil-540i 166 Report post Posted October 10, 2013 Pretty sure the offence is 'failing to display a current....'. Correct - that's why people can & do still get ticketed if the 'human element' leads to mistakenly putting the new vehicle licence (rego) behind the old one - if its got a current vehicle licence, but it is not displayed - you're still open to be ticketed... Phil-540i 166 Report post Posted October 11, 2013 I guess you'd be Ok if the car was on a trailer out on the road. Assuming of course that the trailer had a WOF and rego Yes, because technically its no longer a vehicle - its a 'load'.

Phil-540i 166 Report post Posted October 11, 2013 (edited) That is genius. If only I had a trailer that my car will fit on, that's got wof & reg too........... I've fixed that up a bit for ya............. Of course, once its on the trailer, the only thing to worry bout then when its out on roadside, is the drop-kick midnight spares retards hooking up the whole lot & dragging it away........ bezzal 1 Report post Posted October 11, 2013 In the day you were able to tow a car with no WOF that could not be started, we used to remove the battery. Can't remember if it had to be reg or not but it didn't need a warrant. This is how we used to get out to the Waimak with old cars to "practice" rally driving. This was 20+ years ago so may not be relevant anymore. The point is if it was on the road being readied to be towed....long shot.

If its the place you are meaning, I'd be real keen to know when ya were last out that way - I went back earlier this year, & was just shocked at what's changed out there........ If its the place you are meaning, I'd be real keen to know when ya were last out that way - I went back earlier this year, & was just shocked at what's changed out there........ It has been 5+ since I lived in CHCH, and it has changed a lot over the last 20 years. I used to ride motorbikes out there a lot. Military zone was(still is?) the best. The access down there has been greatly reduced, no wonder though with all the idiots down there chucking rubbish out and ruining the stock banks. Spent a lot of time out there 4WDing as well in my old Range Rover. Great resource to have so close to the city however, 15mins away compared to driving out to Woodhill to go for a blast (which is only 45min so not to bad). You can still go crazy in a jet boat down there however!

Yea - that's what I'm meaning - I used to spend lots of time out there in 4WD's, (& it'd be nearly 10 yrs since I'd been out there)......I was absolutely gobsmacked to see that some needle-d1cked pencil pusher within the Canterbury Regional Council has been able to sign off stealing away public access to public land, to the extent that's happened!! Unbelievable that Cantabrians let that happen!! Jetboats, yea true - obviously only until some lentil-munching jandle-wearing muppet complains about noise or wash though.........
