you have the right to take the other guy to court and his insurance company will pretty much have to come to the party . i had a guy do a U turn in front of me a few years back , i claimed against his insurnace company ,as i h=only had third party . they where going to write off the car and pay out about $1000 , i told them it was worth alot more than that to me because i had done this and that etc . so they ended up paying out enough to cover the repair and i sent them a bill for a rental car for about 4 weeks too (company van from where i worked) they paid that as well

after 4 years and 50,000km of service , my 92 325i coupe has been sold . had 240k when sold has been a great little run around . no major problems with in the time i had it . just the odd cosmetic bit ,fan belt and a failed ac pump . it starts its new life as a race/track car for the guys who run the playday on track company . some shots a couple of days before it went (i kept the wheels ,stereo and m3 vader seats for my replacement 328i coupe though)

i think if you say you want it repaired here they can do nothing about it . just threaten court action if they dont comply. or make sure you repairers quote is on the mark as far as price goes
