Never ceases to amaze me that in a country this small, with so much activity in niche groups, there still seems to be an endless stream of rare(r) vehicles popping up. -
My experience in similar accidents (although anecdotal) is that the reversing party is almost invariably found to be at fault. No excuse for the speed the van was moving at, and the van driver would have had a decent view of you and your movement, and should have acted accordingly. He was probably on his phone so not looking at the parked cars.

I was wondering how far this could go. Generically, and assuming Person A has an upheld case for breach of contract, could Person B find themselves in a position where they are (effectively) in possession of stolen goods?

It seems Brad had his offer overturned (too). Although until he wrote of it here, I wasn't aware of it. Someone else I know of, a thoroughly nice member of the forum, had agreement, verbally and in writing, that he was buying the cars at the asking price. He'd asked for bank details so he could transfer a deposit to the seller, with balance to be paid on collection - this was all agreed. There was a lot of organisation going on, arranging funds for transfer, sorting transport - all the usual stuff. Then the seller pops up and says "Sorry, I've agreed to sell to someone else who has offered more money." Not even an opportunity to increase an offer. Just nope - sold to someone else. The buyer I know of was understandably very, very disappointed. Yes - sale goes to the first person in, but once agreement has been reached (especially in writing), it's normally fair to consider yourself to be that first person. The buyer with the higher offer is understood to have been aware that a sale was agreed. We think we know who the buyer is (we aren't sure, so will say nothing), but I suggest anonymity is unlikely to last long with cars like this. Personally I feel that both the seller and the buyer who made the higher offer have both acted extremely poorly. I'm annoyed, and I hadn't even considered making an offer!

Sold to 'Charles'. Who has complimented the seller on how well he looked after the car! ? So tempted to point out that the seller had only owned it for 5 minutes... Credit to you, Chester, for how well you looked after the car. -
Ooh! BMW NZ could buy back our daughter's 318i! It's not quite in the same condition it was when it left the factory, but that won't affect an airbag recall, will it? ?

I was very happy to read of the sale, until I heard that the person I thought was the buyer had been gazumped.

Update... Ordered from FCP Euro on 22/10, with (free) delivery to MyUS. Updated by MyUS and shipped to NZ using FedEx International Economy, where it was delivered this morning - 5th November. Two weeks order to door. Takes NZ Post that long to get something through customs (having already spent 3-4 days getting it from the plane to customs), then that long again to deliver in country!

Following the wisdom received hereabouts, I've ordered 4 shocks/struts from FCP and am having them shipped to a MyUS address... Shipping in the US is *free* so that's one cost out of the way. Let's see how it goes. Can't be worse than my last experience!

The US market is a difficult one to gauge. 5-speed manual 325iX Touring for $3k or so, or a late model good 4-door auto for $15k. All prices, all sizes and shapes... -
