That's a good point. These are really lazy in that regard. Maybe tickle the motor and stick in a more aggressive diff. The 850 was designed for continent crossing. Not NZ back roads.

Really? Interesting. My old man had a 750i back in the day. I drove it several times. I agree it was a bit of a monster, wouldn't let up until over 225kph as I remember. But I doubt it would stay with my M5. Maybe I should take you for a quick run. change that perspective.

spend the $ on the branded expensive stuff for complex and important tools. $300 for a power bar. ffs. Snapon trade on their lifetime warranty. So really worth it for those in the trade. but less so for the home mechanic.

plenty also don't realise that their 20yr old speedo is inaccurate. I'm sure they are sitting on 100 on their dash, but my GPS says your going 84 buddy. So get out of the freakin fast lane and let people past.

literally having this exact conversation with the wife last night. Was able to keep my speed by moving between lanes 1 & 2 as the "fast" lane was blocked with slow moving traffic. Oh and Andy, the "flash the lights please move" routine is literally pointless here. It's usually not the guy directly in front of you. It's the preceding 27 cars.

the dude is buying a 2nd hand iphone 4, sight unseen, off trademe. there's some risk implied with the purchase. The phone has to be a few years old. Have you tried offering him $150 and call it "stress relief payment" and move on? he could probably get the phone fixed for that. save him the time and cost of the tribunal. at the very least at the tribunal you could state since he offered no evidence as to the fault it was the best you could do.

I had a witness provide phone evidence from afar, but yes I don't know how they will work the distance. Obviously requesting one party or the other to travel wouldn't be practical. In my experience they weigh up given evidence. So you say it was perfect, he says it's got a fault. Unless you can get a report that shows there's a visible dent that may have caused the damage that you could prove that wasn't there before... Most likely outcome is you will be asked to pay him $150. Edit: Those emails will help your case. Be sure to submit them to the court. they might just rule he's not willing to resolve.

lol... yeah I'll take a O for orsum. I like reading interesting cases like these. I think he's being unreasonable. He should seek a professional report to repair and provide you with this. For all you know he's dropped it and taken it to some nitwit saleman in a telecom store whom has said it's stuffed. You have no way to know if he's even telling the truth, has have provided any evidence that it's faulty?

I'd agree with Karl. You are selling on an auction site. You are not a trader therefore the consumer guarentee's act doesn't apply. There's no warranty expressed or implied. If you don't want to come to any agreement in regards to a refund, then goto the tribunal. Let them decide what's fair.
